  • GREEN CARD & I 130 question(s).....from THAILAND

Hello, I am US citizen married to Thai wife. We have 2 children together that are US citizens. We've been living in Thailand since 2005 and we generally fly back to US once a year, my Thai wife using the US Tourist Visa.

We want to move back to US full time in March 2015. My wife wants to get her green card and I 130 marriage visa. Is it better to apply with US Immigration online and get her green card

started now or wait until after we move there. We are for sure going to move back, just want to know what forms we need to fill out, i.e. green card and I130 (marriage) under family sponsor

program and the best time to start the paperwork. I saw that US Immigration website has a step by step process to obtain the green card and I130 but I wanted to ask for help from someone

    who has experience.

THANK YOU IN ADVANCE. ANY HELP WILLL BE APPRECIATED.

    You have two choices:

    1. If you apply for our wife while she is in the U.S., you will submit I-130 and I-485, with supporting documents, at the same time to USCIS.
    2. If you are prepared to have your wife processed for her visa in Bangkok, you submit only the I-130 by mail to USCIS (Stateside), unless the Bangkok U.S. Embassy will accept a "Direct Consular Filing."

Option #1 above will be the least amount of hassle and waiting, so long as you have the advantage of your wife being in the U.S. to be processed there.
