I am currently on h1b. Came in US 7 years back on F1, got 29 month opt and got h1 done in 2012. Current h1b is going to expired in this September and the same for i94. My project was completed three months back and currently I am on consultancy payroll, supporting inhouse project and looking for a project. Employer is running the payroll, and will run the same for last month. However suddenly I am notified that if they can't get the project they'll revoke visa by putting the date end of the last month i.e. may. I've no other employer in hand to whom I can do h1b transfer + extension. I saw that there is u1 visa for the victims of crime. I was the victim of crime 6 years back, and was assaulted, got physical injuries, was hospitalized, needed to take off from study for few months. Below are the concern regarding to this situation if anyone can put more light, I really do appreciate. Seeing this website has helped a lot to people like me, and expecting the same.
- If my employer send a notice to USCIS by referring end date of employment end of May, can I still apply for U1 visa?
- I heard 30 days is the time one can stay in US, but not more than that. If I start U1 visa application this week, can that stay be extended? i.e. Can I stay with valid status in US more than 30 days?
- If revoke is initiated with last day of employment 31st may, can I do h1b transfer in the 30 days I've?
- If I can stay more than 30 days in US with starting U1 visa application, if it is denied will I get time to change visa to f1 or other visa category?
- If h1b is revoked and I start applying for U1 visa, will there be a work permit given when U1 application is pending?
I'll surely be seeing an attorney, but appreciate if any information is shared.
