J1 waiver and O1 application

My attorney is ready to apply my O1 visa, but still waiting for the J1 waiver certificate. From Dept. of State, it shows that the recommendation letter in favor has been sent on June 30. In this situation, with the copy of this website update, is it possible to apply for the O1 VISA mentioning that I will change the status inside USA not in India? I have only this month to stay in USA.
