  • Which visa type do I belong? Help Please!

    Hi

    I am a web developer / graphic designer working online for 6 years now (No formal education, no college degree). I built my own online web design business and met a client. This client plans to build his own web design agency and plans to move me to US and work there for his new office. I have no plans to migrate or get a green card. He will hire a lawyer to do all the paperworks and stuff. Which visa type does my case belong to? If there is, which one would be the fastest? Hopefully someone can answer me. I've been searching for same cases like mine, but I can't find anything online. Thanks in advance.

      B1 Visa

      B1 Business visa is applicable for you. This is for the people who visit USA for business purpose. This is for temporary visit. Validity varies from 1 to 10 years, which allows multiple entries with this period. Maximum is 6 months stay, once every 3 months, you need to go out of country for short period of time and again visit back for renewal. This can be repeated till the validity of your time mentioned in the visa.

        But this client of mine, wants me to work there in his newly-built office as a full time employee. I've read that working on a B1 visa is illegal. If this client will sponsor my stay as a B1 visa holder and will soon petition me to change to a Working Visa (within the US, is this possible without degree?), will it be illegal or questionable by the USCIS?

        Am I eligible if I declare to be a business partner of the sponsoring employer? Since he is my client in my web design business? How is this?

          You mentioned in your first post that your employer is gonna hire a lawyer to do all the paperwork. If I was you, I would contact this lawyer and ask him all those questions.
