My Mother (aged 65 years) is a green card holder since 2006, she has never worked or paid tax and has hardly lived there since she got the green card. She is now settled in the US and is in the process of getting her green card renewed and once this is done,she would like to file form I-130 for My self and my Son. Since she has not paid any tax can she file form I-130? if need be we can arrange for a co-sponsor.
I recently got divorced and want to now live with my mother and son in the US. Both my Son and I hold valid B1/B2 visas. After the I-130 has been filled can we apply for a change of status once we are in the US? Also when should I enter the US before the I-130 has been filed or after?
