Hello, Could someone please provide me information on my situation.
My dad (Lawful permanent resident) filed a I-130 for my brother who is 20 years old as of now and the I-130 is approved. Our priority date is October 1, 2015. My dad at this time wants to file I-864(I will be filing I-864A and take care of all financial aspects) and travel back to home country in Asia with a re-entry permit and take care of family matters and come back with my brother(the applicant) once his interview is done. Can he be out of the US while NVC processing is ongoing and during my brothers interview in home country or does he have to be physically present here?
Also, since the applicant will likely be turning 21 next year, will the visa processing be affected/delayed even after the i-130 is approved?
Thank you much!
