I-94w expire while applying AOS

Hi there,

I married my husband while on tourist visa i-94w and currently we are preparing documents and medical exam. But my visa will expire in a week. What should i do while waiting for the process of my application and how long will chicago office takes to process the receipts? Thanks a million!~

Mandy. I believe it would be best for you to stay in the country even although your visa has expired. In reading other people's experiences on this forum, it would seem it is often difficult to come back into the USA if you have allowed any type of Visa to expire. The sense I have got from these forums is that it is better to stay in USA and work on your AOS paperwork. However, I'm not a lawyer so I must throw in my disclaimer. I have a friend who did successfully obtain their GC in this way about 10 years ago. Good luck with everything as the whole area of immigration is a nightmare! Cheers.

Thanks for your advice. Im overstaying now and paper work is plenty and needed bank statment and waiting is like forever. My only worry is during the interview.
