Travel outside of US on I-94card? PLEASE HELP!!!

Hi there,

My boyfriend is an Australian citizen working here in the US on an I-94 card (he's been working at a university for the past 5 years; I think he's on an H1B visa). What paperwork does he need to obtain to travel on a cruise to Mexico for one week? His boss at the University said that he could not obtain a visa locally in order to get back into the US from Mexico. He would have to to go to US consulate outside of the US to obtain a re-entry visa on his passport. And he may not be allowed back into the US anyway if it's not approved at US customs. That sounds absurd! Please help me find out this information! Thanks!

If hes on HIB status, changed to that status after he came to the US on another nonimmigrant status,and leaves for the first time,then he would have to go the US consulate to obtain a VISA to reenter. If that is his case, what he has is an approved H1B petition which allows him stay here and work, if he leaves, he will need a visa to reenter the US. It might sound absurb but thats exactly how it is. But anyway, its hard to advise if your e not sure of exactly what his visa status is.

Travel question

Hi,
Have a NATO2 visa valid till Sept 07. UK citizen. Retire from Forces Sept 07. Applying for EB2 (NIW) (want to file I-140and I-485 concurrently) need to travel extensively in current job with NATO2 visa. Can I travel in/out of US on my NATO2 visa while petition is pending or do I need AP as well? Can I also file for EAD at same time? Thanks for any help.
