What should dependent children write in Q. NO. 33 of DS-156

    Hello,

    I am a graduate student here in USA with F1 Visa. Now, I would like my wife and two daughters to join me. While filling form DS-156 for student dependent visa, which I think is for F2 visa we are confused what should be written in Q No. 33 for my daughters 8 and 13 yrs old.

    Q 33. Do you intend to study in the USA?
    (If YES, give the name and complete address of the school.)

    Well, my wife will write NO.

    But should my daughters write Yes or NO. And If they write yes, should they give the would be school name situated here in USA. If we give name of school, should we provide some more documents from those school?

    Hi Mr. Pradhan:

    Probably u would end up opening a pandora's box if u were to answer the Q as Yes, cuz "Congress passed a law in 1996 that placed restrictions on foreign students in U.S. public elementary (kindergarten through eighth grades) and secondary (grades nine through twelve) schools. Secondary school is also called high school. The restrictions are given below:

    1) prohibits foreign students from attending public elementary schools or publicly-funded adult education programs (not applicable to you)
    2) limits secondary school attendance to twelve months (maybe applicble, depends on how many terms u got before u graduate)
    3) requires secondary school students to pay the school the full, unsubsidized per capita cost (cost for each student) of education" (definitely applicable if u plan to send ur kids to a public school)


    So under the circumstances the best course of action for you would be to say that ur family is planning to visit you for a short duration (as a holiday maybe) and would go back to India to continue their schooling...This way u will meet the INA stipulation of returning to ur home country and also wont get involved in a situation where u may need to pay the school tuiton in advance (and show documentation in support of their admission into a US shcool...Plz understand that this stipulation is applicable only if ur children plan to attend a public school, and not a private school). What u do once they join u is a different story....Hope this info helps u ...
