    I married 2 a US soldier, and i came into the US legally with B-1/B-2 visa last oct. 2005 and my visa get expired. and am out of status now and i had a baby born here in the states. and my husband been deployed in iraq and he wont be back till january 2008. What (if anything) should we be doing to clear this up.

    I would assume the US Army have lawyers that can help you with this issue. Did you try that?

    If you married your husband AFTER your visa/I94 expired, you've been illegally in the US since then.

    If your I94 and/or visa expired AFTER the the marriage, and you and your husband didn't file for adjustment of status, you're also illegally in the US.

    In any case, you can be deported at any time - the fact that you have a son born in the US makes (again, sadly) no difference at all.

    As said: call your husband. He should be able to talk about this to his NCO and his NCO should be able to kick it up the command chain - see if they can get you some legal help.
