  • Form I-601

    I entered the US on my B2 (visitor) visa to join my husband. i had my GC interview yesterday and the officer made me sign a paper that i violated the visitor visa and that my intention was to enter to live in the states. he then asked that we file form i-601. does this mean i will be denied the green card. is there any hope. is there anything we can do. we told them the truth as they asked for. many people enter illegaly and they got adjusted. i entered legally but seems i will be separated from my husband.

    NOBODY who enters illegally can adjust their status in the USA (except very few exceptions).

    Also people should NOT, enter using a visitor visa (non-immigrant visa) with the purpose of staying indefinitely in the USA (immigrant intent). So you did violate the terms of your visa.

    You need to file that form now, it is a waiver for you to be deported and so that your GC may be granted. I recommend you get a good lawyer to help you with this.

      we have been trying to find an attorney to help us with form 601 but so far we are unable to find one. Can anyone guide us on what we should do or recommend an attorney. we live in new jersey.

        I had my interview yesterday jun 12. And I had the same situation, exactly.

          This forum discussed the 601 form extensively and can refer you to an attorney with expertise in the field.

          Their server is not the most reliable and I had trouble getting into the site just now so try later if you cannot do so.

                  I'm sorry I don't. I do suggest that you contact the attorney suggested on visacentral who specializes in these cases and keep checking for the website to come back up as it contains samples of letters used to obtain the 601 waiver.

                  You are looking a a process that will likely take several years to complete so start with the attorney next week.
