I am currently on a student visa and taking summer session off. 5 months ago, I had applied for an H1 and am currently waiting for INS to approve it. The ball is in INS's court and their recorded message says that it could take another 90days to get to a decision. My question is, while I am waiting for my H1 to get approved, would I still be in status even if I don't register for the fall session, which is due to start in August? Secondly, what if my H1 visa gets rejected? Am I still in status until I register for the spring 2002 session?
