  • H1-B visa transfer

    Hello,

I am currently living outside the US. Company A has filed for my H1-B starting Oct.1 2009 and it was approved. I have not gone for stamping yet. I have been also interviewing with Company B and they offered me a position and I want to take bc a much better offer. They want me to start Oct 1.

I dont want to file for a new H1-B application subject to cap but simply transfer my approved H1-B from Company A to Company B. Is it possible? Is it possible to tranfer the H1-B in this situation, prior to entering the US and prior to starting working to Company A? Also, if it is possible, do I need to first get the visa stamped before transferring it?

    Thanks!

Yes, it is possible. But you need to have proof of prior approval(a copy of I797 or the receipt number). Read the FAQs.
