  • Own house in US. Out of country due to expired H1? Which Visa now?

    I am an Indian citizens residing in US. My husband and I bought a home in Minnesota around 1.5 years back.
    My husband had to leave country as his H1 visa expired (Just before that he got layed off and his GC process stopped).

    Which visa he should apply in case he needs to enter US for some home maintainance?
    I am currently on H1 visa but I intend to move with him out of US sooner i.e. in next month.

    Tough situation. As he has already expressed immigrant intent applying for a GC, it will be tough to get a visitor visa (not impossible) unless he proves otherwise that he will return back to his home country.

      If he just wants to sell the house, he may apply for visitor visa with that specific purpose. If you are in H1 status, he may also apply for H4 visa.

      Secondly, there may be something like power of attorney which he may execute in your name that allows you to sell the house. You can take legal advice on this.

        Can not apply H4

        We tried sellingthe house for 8 months. As everyone is aware of the house market crises, we could not sell it. Instead of bearing the house payment, we rented the house.
        Eventhough we have hired a property management company, we are still responsible for the house and would like to keep an eye on it occasionally.

        He cannot apply for H4 as, My H1 is valid only till October-2010. Apart from that, my current project is till Feb 2010 and I intend to move with him in Canada.

        We are trying to seen legal advice, Can anyone please recommand an immigration lawyer?
