On september 18 2009 my h1-b petition was approved but my change of status was not approved. My change of status had not been approved due to the expiration of my i-94. I had travelled out of the u.s to the u.k before my 1-94 expired and had travelled back into the u.s since my visa did not expire till march 20 2010. I submitted a new i-94 since and filed a notice of appeal to the commissioner with my new i-94 requesting for my status to be changed from b2 to h1-b.
My b2 visa expires on the 20th of march. I have not gotten any response from uscis. Do i have to wait till i get a response or should i leave the u.s before it expires and go the consulate in my country to get the h1-b?
