O-1 termination airfare reimbursement
Hello all,
I was terminated without prior notice by my employer few months ago while on an O-1 visa. I continued to be in the US on valid status as a dependent of my spouse who works in the US. However, I will be returning to India permanently in a few weeks. As per theUSCIS rules, an employee on O-1, upon termination, is entitled to one-way airfare to his home country from his ex-employer.
Am I still eligible for the airfare re-disbursement, despite staying in the US for few months following termination? What is the legal recourse if my employer refuses to pay me?
