  • Canadian PR card holder needs a TD visa stamp

    Hi!
    I would like to know can a Canadian PR card holder whose spouse is currently working in USA as TN can get a TD visa stamp at the USA border/ port? I have B2 visa and staying in USA almost 5 months now. I know I can stay only 6 months the max as a tourist. Applied for statues changed stay as T non immigrant but Vermont service center way too slow. Seems like I have to leave before they process my case. Waste of $500. Also I know I can’t come back cause the 6 months stay will be over. Any idea If I can get a TD visa At the border proving the all documents?

    One can never get a visa at a border. You can only get a US visa at a US consulate.

    If you are already in the US, you can apply for Change of Status. You can stay in the US for as long as your Change of Status or Extension of Stay application is pending, no matter how long it takes.

      The problem is when I last checked the T as Nonimmigrant processing time at Vermont center it was showing Jan 16 2021 rolling. Then suddenly kinda vanished the T processing time from the list. Then today I see they moved back to Dec 30 2020. What a joke!!
      and the funny part is TD processing estimate time was 2.5 to 4.5 month when I applied. Then changed to 5.5 and now 6.5. Amazing isn’t it!!

        T and TD are different statuses. T status is for victims of human trafficking.

        Anyway, like I said, you can stay in the US for as long as a Change of Status or Extension of Stay is pending, no matter how slow it is.

          I applied for TD ( TN dependent).
          Seems like haven’t touched my case yet. I am running out time. If my case doesn’t show pending in a month I have to leave by no choice. My 6 months stay as tourist will end by August 5th.

          It will be very frustrating for me. Paid $500, applied 5.5 months ago, not showing pending, have to leave, what a Joke!!

            Again, no, you do not have to leave. As long as you filed I-539 (Extension of Stay or Change of Status) before your status ended, you can stay for as long as the I-539 is pending, no matter how long it takes.
