Fiance has a pending matter

My finace is a US citizen and I am not, he was recently detained and is in a holding facility/rehab center for a few months. We are planning to get married in a few months when he is released. I will like to move to the US with him after we are married, since he has that matter right now, will this interfere with him filing for me?
