Got married right before GC is approved. Now What??
I got married 7 months before my Green Card was approved, My I-485 application stated that I am still single when it was filled. (I was not expecting it to be approved so quickly after the marriage, we are still preparing documents for her when I got approved, probably a wrong move)
She is here with me in the US under H1 visa for 5 years now and her employer placed her greencard petition on hold due to layoffs in the company (she is on labor cert stage only). We have a year to do something or Else her visa will expire and she will be out of status. (we cannot file for a h1 extension right?)
Can we use the "FOLLOW TO JOIN" petition in our case? knowing that we got married even before I got my GC?? and if this is the right move, is this a quick one??
Any suggestion is highly appreciated.
