Hi, I am on H1B 6'th Year (including all my vacation)and its going toexpire on 12/15/2012.My labor got filled on 04/02/2012(After 365 days limit of visa expiration) I got General Audit on my labor on June 2012 and my attorney has responded to the Audit(RFE)in month of July'2012. GC PD is on 04/02/2012.My employer is trying to process of my 2nd Labor by end of this month and is there any issue if we file more than one Labor from same employer. I would like to change my Visa to F1 for maintain my status to stay in US.Is there any issue if we are going to change of status from H1 to FI?. How many days before we need to file F1 before expire my H1 and is there any time limit? Please suggest.
Please let me know which is best options:
1.convert H1 to F1 until LC get cleared/decision
2.Get Canada Work permit
3.Leave for India and come back on H1 extension if once LC and 1-140 got cleared?
