  • Please help: F1 To H4 Change of Status.

    Hello Everyone,

    We have little confusion understanding getting onto F1 from H4 visa. Please go through the following scenario and let us know your valuable comments.

    My wife is on H4 visa that is good till April 2015 and she wants to join one university and probably work after her graduation.

    1. Some universities are ready to admit her on H4 and process her Change of Status COS to F1 that might take few months of time. So, it will be one semester done when she would be on F1 status, is that a problem?

    2. While she gets admitted to the university, the school asked her to pay in-state tuition. So once she gets her F1 COS approved, would we have to pay the out-state tuition?

    3. During the studies, what if we plan to visit India? She will definitely have to get F1 stamping, and if she gets denied; will she be able to return back on H4?

    We will be really grateful if you are able to answer any of the above. Thanks you.

    1. No problem about the semester. Whenever the approval comes, it will have a date on it, so her F-1 status becomes active from that date. This date is usually the date that was requested on the I-20.

    2. If the F-1 status becomes active before the semester start date then she will have to pay non-resident tuition for that semester and after that. I had got my approval in may-mid and semester was ending in 2-3 weeks, there was no change made to my semester fee. From the following semester, I paid non-resident rate.

    3. Depends if the H-4 visa is still valid, if it is not valid she can definitely apply for H-4 (usually not denied I assume??) and enter on H-4, then complete heer studies.
