  • Doubtful about changing status from B2 to F2!

    Dear All,

I am currently studying in the US since september 2012 on an F1 visa. My F1 expires in 2017 but I will graduate in May 2014 . Since I am studying Business, therefor i can only get my OPT for 1 year. I am getting married in January 2014 and my Fiancee has a 10 year multiple entry US visa. Now we are not sure how to proceed once we get married in January next year (2014), whether to bring her to US on her visitor visa and then apply for an F2 once i start working or whether to apply for an F2 in January. What if her F2 gets rejected, would my spouse still be able to come to US on her Visitor visa or does her visitor visa gets rejected too?

Kindly advise, so that we could start making financial arrangements. I would highly appreciate any help on this matter.

    Regards,
    AD

Change of status from B2 is not recommended, it can create problems in future Visa applications. But it is possible.

She should apply for F2 Visa after you get married. Since she has a B2 Visa, there is a higher likelihood that she will get the F2 Visa. But one cannot predict. F2 Visa is more difficult to get once you graduate and start your OPT.

Also, if F2 Visa is denied, the consular officer at their own discretion may or may not cancel the existing B2 Visa. It is likely that they will cancel it also.
This is my opinion and not legal advice.

Thank you so much for your help.

I understand that one cannot predict the result of F2 interview and because of that I do not want to risk getting it rejected. All i want to ask you if it would be alright if she visited me in US on her B2 visa till i get my H1 in October 2015. Would there be an issue with that. I have read of several people who do visit US regularly on their B2.

I would really appreciate your response on this.

Yes, she can certainly visit you for 6 months using the B2 Visa, return and then come back with H4 Visa.
