  • Help F1 Overstay questions

    In the event that a F1 holder overstays visa (post 60-days of graduation and OPT ending), for a period of _under_ 180 days:

    a)
    If wanting to enroll in school/academics (get back into f1 status), does he need to leave the country to get a new visa, or just get an I-20 from the issuing school and thus be back in status?

    b)
    If offered an H1 by an employer, and paperwork is filed and approved ,can he be put into h1 status while still overstaying in the US, or does he need to leave to get an H1 visa stamp?

    c)
    (can paperwork for H1 or F1 even be approved if applicant is overstaying?)

    Yes you can go back to school and enroll in a new program and thus be in status Just getting an I-20 does not help you gotta enroll for classes becos later on in the sevis if they find you not enrolled you will land in to big trouble and hassle

    As long as the h1-b petition is being approved within the post 60 days grace peroid after your OPT you are fine and you can stay legally. But make sure when is your start work date with your employer
