I am Indian and currently on an H4 visa in the US and have got into an accredited MS course which starts at the end of Jan. I want to transfer my visa from H4 to F1 (the F1 will give me a lot of benefits like SSN and the possibility of a campus job etc.) I am also a UK permanent resident and have plans to go to the UK in the next coming weeks. Is it advisable for me to change my visa from H4 to F1 in UK directly or do a Change of Status application internally once I get back.
I'm worried because having my husband working in the US, it will be difficult for me to show a 'non-immigration' intent. Can I just come back to the US on my H4 if my F1 visa application is rejected in the UK?
