My OPT is about to expire!!!

Hi,

My OPT will expire on 14 October 2005. I am currently working in a company on OPT.
I already filed my H1 papers and received the EAC #. But my H1b is in query and it will take some time to get the H1b approval.

My question is "Will i be eligible to continue to work in the same company with expired OPT & H1b application in the process".

Please answer to this as it's very important and urgent.

Nope if it is approved by Oct 15 2005 u are fine but if it is not then u are not eligible to work. till that is sorted out

Tell ur employer that you will be going on a vacation to bypass the time lag till it gets approved and join back again later.

If u wanna take some risk u can go ahead and work but if u regret it later it's not that you did unknowingly
