    Hi everyone,

    I am on green card (permanent resident), my wife is M1 visa. Applying for citizenship by the end of March, 2014. Her visa expires March 1, 2015. I am looking for applying for I-130 for her. She does have annotations on her M1 that she doesn't have intentions to immigrate to US. Will she still be eligible to apply for I-130?

    What is the specific annotation on her M1 visa that she "doesn't have intentions to immigrate to U.S."?

    Reason I ask is because there is no prohibition with any visa that an I-130 cannot be submitted. Several visa types, however, do not allow conversion to Permanent Resident status while remaining in the U.S. (C visas, J1 with 2-year requirement, etc.).

    Perhaps you read more into something on her visa or annotation than was needed. But if you quote the specific verbiage you cite below, and where it shows on her visa or passport, a better response might be forthcoming.
