  • Change of visa status from F-2 to H1-B

    Hi,

I am on an F-2 visa (dependent on F-1) right now. I want to apply for jobs in the US, which means i am assuming i need an H1-B visa. (Or, is there a provision to get an EAD??).
What is the process i need to follow for the change of status? Do i need to go to a lawyer or do it thru the software consultants who claim to do it?? ( i have been working in software for 5 years and i am going to look out for software jobs in any case)
I realised that the USCIS site talks abt the change of status...can we approach the issue independently, by filling the form and approaching USCIS or it is better to go with the help of an attorney/consultant?

    Thanks a lot!!

As far as I know, you need to contact an attorney. Again there is a cap on H-1B. Means us govt wont issue more than 65000 H-1B in an year. This year it is over. Now you can apply on Apr 1, 2006. (All 65000 may arrive the same day). Now the attorney you get should be smart enough to handle the case without any loopholes for rejection. They can be from anywhere in the us.
