I am writing this behalf of my nephew. I filed USA petition for my brother 7 years ago (India). Now my nephew 23 years old and would like to come USA for study. His name is under my brother petition. can anyone answer if he can get student visa or not because his name is under F4 filing.

What to bring to the U.S. student visa interview
When interviewing for your U.S.A. student visa, make sure not to arrive earlier than 15 minutes before your appointed time, and bring the following documents with you:
Valid passport and previously issued passports
Recent passport size photograph with a white background (50mm x 50mm)
DS-160 confirmation page with barcode
HDFC visa application fee receipts
VFS appointment letter

student visa
Usually when someone applies for a new visa their old application gets cancelled out. I'm not sure about this but you should check with an immigration lawyer.
What I do know for a fact is that student is a non immigrant visa and your nephew would not be able to prove non immigrant intent given he was already included in an immigrant petition. So please do double check with a reliable attorney so as not to affect this young man's prospects!Comment
