I was denied opt extension in August 2014 on the grounds of more than 90 days of un-employment first, but I have filed for an MTR stating that USCIS has incorrectly counted the days I was out of US (during which I was employed too).
So, I left and got an H4 visa on Oct 9th 2014
On Oct 20 2014 USCIS approved my petition, and in the petition they have approved my OPT extension from May 2014 (my original 12-month opt expiry date) to OCT 2015.
Now what happens? Which is valid now?
Because OPT was back dated, is that valid or the latest H4 is valid. I am still in India.
I contacted my university and they have raised a request to USCIS to updated my SEVIS record and once that is done, they will send me a new OPT 1-20?
But, should i go to stamping again in India for an F1-Visa. My original visa is still valid.
please help.
