my husbands f1 visa terminated, and i applied for i-130

  • my husbands f1 visa terminated, and i applied for i-130

    me and my husband been married for going on 2 years now, and his F1 visa got terminated but i applied for I-130 for him days before the F1 got terminated...

    the I-130 is still processing and im just wondering what if:

    1) my husband stays in the US even though he still have a valid visitor visa?

    2) me and my husband decided to leave the country for half a year or so to visit a family would that cause anything negative or bad towards the process?

    we just trying to make sure what is safe to do in our situation and want to do the right thing if someone please can help us and advise us with what to do it would be much appreciated

    NOTE: his visa was terminated because of a low GPA after being in probation, and the last GPA was low because he was mis advised by his student adviser at the university! which it wasn't professional at all to let that happen...

    If the F1 was terminated he can probably apply for a reinstatement. As long as the reinstatement is pending he can stay in the US. If the I-130 is approved then the reinstatement won't matter anymore even if it's denied. Your past travels will not affect your I-130. If your husband is outside the US now however, then he will not be go back to the US until he has the green card. He will not be able to reinstate the F1 and he will not be able to apply for a new one because the I-130 is pending.
