    Hello Everyone,

    I have been out of status for more then 6 months and my passport expired after i was out of status. NY India Consulate is not issue a new passport until i regain my status.
    Now me and my girlfriend are planning to get married and apply for my green card so i can regain my status. I wanted to know can i get married in State of New jersey if i don't have my valid passport? I don't have any other US issued valid photo ID. I have my birth certificate which is translated in English and attested and my valid India PAN card which is a photo id.

    Did any one gone through the same issue and know a solution for this?

    Talk to an immigration lawyer, the unlawful presence is a problem but you can probably fix it if she's a US citizen. You don't need a passport to get married, however the federal marriage certificate probably will take 6 months for you to obtain so... that's a while. You can probably sign some sort of waiver so you can stay in the US, but again, talk to a lawyer about this because it's very tricky.

      All marriage certificates are local, i.e., county, parish or borough.

      You will need credible ID to apply for a marriage license.
