Issue Regarding Change of Status

Hi

I came into US on a F1 visa for my PhD and my wife came on her H1B visa. I had some issues with my professor and had to drop from the PhD. I thought at that time to take some break and transfer to a different college. To maintain my status i had applied for a transfer to H4 visa using my wife's H1B Visa. But the Transfer to H4 using I539 has been delayed for more than 5 months now and i am not able to do anything. I wish to move back to a F1 visa, but my sevis has been cancelled and my visa status is neither F1 or H4, with the case currently pending with USCIS. Can you please suggest a future course of action in this case.

I'm guessing but may be wrong that you cannot go back to the F1 visa now. You probably cannot apply for a new F1 visa either until your application for the H4 is done. If it takes a while I recommend you do an InfoPass (visit the USCIS infopass website) and ask an officer. You should also ask your questions to an immigration lawyer.
