Hi,
I intend to apply for a change of visa status from F-2 to H1-B in April 2006 thru a consultant. The consultant says that he will be providing my current I-94 details for this change.
I plan to visit India in August. (my H1-B might or might not have got approved by then).
I have the following questions:
1) Can i visit India during the period when my H1-B is being processed? I understand that i will be issued a new I-94 when i enter the US again in September. (which will be different from the one provided in the H1-B application) Will this cause any problem with my H1-B visa processing?
2) If my H1-B gets approved before i return back to the US, will there be a problem in me entering the US? My understanding is that when my H1-B gets approved, my current visa status i.e. F-2 will be cancelled, but at the same time i would not be having an H1-B visa stamping on my passport.
