My sister, who is a U.S. Citizen, filed an I-130 for me in December 2014. I know that the waiting time is around 10-12 years so I don't wish to continue it. Meanwhile me and my husband got Canadian PR and moved to Canada. Now I wish to do Masters or a Graduate Certificate from US.
I'm planning on applying for student visa in November this year but I'd like to make sure whether or not I'm eligible for an F1 visa while I have a pending immigration petition.
Furthermore, I already have a 5 year multiple B1/B2 Visitor visa that i applied in 2013. I have visited US twice this year and never violated visa terms. I am currently in US to visit colleges here. Once i get my I-20 I will go back to Toronto and apply for interview at the US Consulate.
Now my question is what are my chances of my F1 acceptance
1. Should I be honest about the filed immigration petition OR I just say that NO petition has ever been filed for me?
2. I really have no intention of migration to US because we already are CANADIAN PR and my Husband has a good job here in CANADA, Does I stand a chance that I get F1.(Because it shows a tie that i will obviously come back to canada after completing my Studies)
OR
3. I should ask my sister to withdraw my I-130 will it be helpful or it doesn't matter.
All in all, should I apply to grad schools in the U.S. while I have an I-130 pending? Should I try to convince the officer at the interview that I can finish my degree within 1.5 years (i.e. way before my priority date comes up) or just tell the officer that I have withdrawn that petition?
WHAT SHOULD I DO I AM MESSED UP I REALLY NEED TO DO MS FROM US. PLEASE ADVISE ME ON HOW TO GET F1 VISA????
