Hi:
My husband's H1B is going to take effect on Oct 1st 2015. He is no longer a student as F1 and his I-20 as F1 will also expire on Oct 6th 2015.
I have applied for change of status from F2->F1 through Elis on June 5th 2015, but until now the status is still pending. And now I am studying in a school as a part-time student(I got a new I-20 from school as F1)
My question is : Is it legal for me to stay in U.S. after my I-20(as F2) expire while my application of change of status is pending?
