Entered USA on H4 VISA in 2010.
Then H4 got extended, I-797 expiry date June2016.
H4 VISA Stamp Expiry Date June2016.
Changed status to F1.
Graduated with MS Degree.
Started working on OPT.
OPT Expiration date Feb2016.
1. If I quit working as of today, will my status automatically change to H4 (since I have a I-797 that expires June2016) ?
2. If I quit working as of today, then use 1 month of remaining OPT time to stay in USA, then visit india for 3 months and come back, can I enter using my H4 VISA Stamp and spouse's I-797?
3. Do I have to apply for F1-H4?
4. Let's say I am applying for Change of Status from F1-H4, In the I-539 there is a question "Has an immigration petition EVER been filed for you". My husband has I-140 approved already, do I answer YES to this question? I am not sure at what point my name is included in his petition.
5. My husband's I-797 expires June 2016. What would be the best timeframe to visit india, considering the fact that he has to get it extended, does my India trip have any effect?
