Hi Guys,
I am confused right now and I need help. I am working with a well known tech company on my first year of OPT which will expire on June 2016. My company will file my H1-B next year(2016). I am getting married next month in India. I want to bring my wife here in United states. She also wants to do MS in CS, so we have applied to three universities which are all near to where I live and they are all average to decent universities. We already applied for Fall 2016 and waiting for universities decision. Now here is the confusion:
Option 1. I want that she come here asap(March 2016), so I am thinking of applying for F2 visa, which we will take appointment dates (probably in Jan2016) after her last name change on passport. After coming here on F2 visa and living in US for one month, we will apply for change of status from F2 to F1, if she gets admission for Fall 2016. As I am reading that the COS takes around 3 to 5 months, in that case it is high chance that she will miss Fall 2016 admission. Fortunately, we are not in hurry and we can defer the admission to spring 2017,if university let us do the same.
Option 2: The other option is that I hold my horses back and wait for her. She applies for F-1 visa directly from India. Advantage: She would be able to attend Fall2016 instead of Spring 2017. Disadvantage: I have to wait for her till July 2016 to come and live with me.
Therefore, what are the chances of her getting F-1 visa given the fact that she is only applying to universities near me and it is obvious she will live with me. Secondly, at that time I will on H1-B filling or approval stage?
I found first option(F-2 visa) safer as we are not in a hurry of getting admission here but if she gets admission in Fall 2016 that would be great too.
Is there any recommended time to stay in US on F-2 visa before applying for change of status.?
Please give me suggestions if someone been through the same scenario or if you know what is the best path to follow.
