I finished my BS in Dec 2009. During 2010, I stayed in the US on OPT but without a job offer. I stayed for a whole year with no job then, I don't know how but I successfully got transferred my I20 to a community college to earn another degree (first semester attend May 2011) and continued on my F1 status.
Then I was able to transfer to my current university to work on my Master degree. Now, I intend to come back home this winter break. My question is, will my visa be denied even I'm in the middle of my MBA program now? I don’t know how I was be able to transfer my i20 after a year of unemployment, but because I was, will it show in the SEVIS system that I was unemployed? Was I out of status or unlawful presence? It happened 6 years ago, will they not take it into account?
I was told that I was only out of status and the 3-year-bar rule does not apply in my case, but then different people told me I will be banned 10 years if i leave the US now. So which one is true?
