Hello Friends
We are in a situation here and am seeking your help and guidance .
We are currently in the US. My Wife is on F-1 visa(expired on 12.2015) and has her current OPT approved starting mid February .
We have a bereavement back in India and my wife has to be there .
She has an offer letter from one of the employers and now we are thinking of the below options :
1. If we Apply for her F-1 visa again for getting stamping in India which we are being told is kind of dicey .
2. We also have Canadian Permanent Residency , If we travel to India and then return back to Canada and re-enter US based
on the Automatic re-validation rule as we will be coming back within 30 days .
3. Come back on H-4 visa which is still valid but will cause F1 visa to be invalid and all the hard work of 2 years wasted .
My wife had one F-1 and F-2 visa denials prior to this back in 2010- 11 due to some confusions .
I request you to please give us some advice on to what is the best course of action here . Will it be possible for us to re enter US from Canada with Automatic re-validation rule applied ?
