Am in the US on L1b.
- My wife completed Masters and is currently working on F1 OPT with Employer A.
- She has applied for the 17 months OPT extension this week as her OPT expires in June.
- Employer A has already applied H1B premium for her
She doesn't like working with employer A due to extreme stress and wants to change her job ASAP and cannot wait until Oct 1st. Pls suggest other options for this issue too..
Question:
If I want to sponsor L2 for her and once she gets EAD, she can start working for the company B of her choice.
1) What would be the status of the OPT once she comes in L2 ? simply put, what would be her status if i withdraw L2 ?
2) Once i sponsor her OPT->L2, what happens to her H1B approval, if she gets it with employer A this year?
3) What happens if the employer B whom she joins with L2 EAD decides to sponsor H1B for her ? Will she be able to use her approved cap and make this possible as a change of status only ?
