  • F1 visa for spouse of LPR

    Hello,

I'm a permanent resident and my husband is planning to come to the US via his F1 student visa.

I wonder, given my status, if there could be any problem at the border when he arrives US.

In other words, could CBP deny him entering the US because I have green card.

    Thanks in advance!

CBP can deny admission to any F visa holder who can not overcome the presumption of immigrant intent. Individual CBP officers at the port of entry have wide latitude in making these judgements

Thanks for the reply and I agree with what you said, but I wonder, in general, if the odds that my husband gets denied at the border will be higher than other F1 visa holders whose spouses aren't LPRs or citizens. Is there any past experience indicating that is the case?
