F-1 Visa ( OPT) DUI first offense

Hello ,

I am on opt and it is valid till september 2018 . Can any one let me know what would the possibility for deportation/revoking visa. If my visa is valid when i am in usa , Can i apply for H1b (or) (f2) or can i join again in another college. What would the possibilites of getting h-1 approval/f-2 approval / getting admit in university in usa. I pretty sure that i need to attend visa interview if i go to india but my concern is about if i am in states what would be the possibility approvals . Thanks in advance .

I think it should be okay but I don't know for sure.

Luckily when i got the DUI back in 2013, i had just got my first H1b stamp and it was not revoked. Since then my company has applied for H1b extension, H1b amendment, PERM Labor and I am in I-140 processing now. So far I didn't have issue with H1b approvals while still in USA. Also, if you just got the DUI, wait to see if you get any email about VISA revocation. If no email, then i think you should be good on your F1 visa till 2018 and can definitely apply for H1b. Just make sure to not lie on any form. Also, please never, NEVER NEVER drink and drive. Do only 1 of these 2.

But if you go out of the States and need to go for stamping it will be a different game. you will most definitely be sent for medical evaluation and after that admin processing can take some time. Not sure how much. Mine is still under admin processing. I will post status update if i get any.

What after this Abhiram? Did you get your H1B or Joined another college? What are the impacts after your DUI? I am in same situation. I have my Stem OPT ending this june and already got admitted for a new college for Summer. I have not recieved any official email about my Revocation since its just three days of my DUI. If yes, what is the impact on joining another college? Please reach out to me
