  • Expired I-94 and H1b to Fl change

On March 27th,2018, I received an H1-B extension dental notice by my lawyer. By this date, I had already applied for a Master's program and got my I-20 admission letter as well.

My I-94 expired on September 13th, 2017 and since then, I have been on my H1-B processing grace period of 240 days.

Saying this, would there be any possible way that I can schedule my F1 visa interview at the US Consulate in Toronto, Canada instead of my home country, India???

I have a valid Canadian tourist visa for 10 years

I think you would have to apply for a visa in your country of nationality, because you were in the US after your I-94 expired and after extension of status was denied, so you triggered INA 222(g), which invalidates your visa and makes you have to apply for US visas in your country of nationality from now on.

This is my personal opinion and is not to be construed as legal advice.
