H1b premium processing for a Higher Education Institution (H1 to F1 to H1)

This may be a slightly unusual situation to be in. I was on H1b a few years ago with almost 3 years still left. And then I transitioned to F1, and now I'm on OPT. My current employer is a Higher Education Institution and is filing for my H1b premium processing. Until now I wasn't aware that these are non-cap institutions and hence can file for an H1b with premium processing.
My question is, can they really? And will it be filed as fresh H1b visa or a transfer as I was on h1b earlier (through a for profit organization).
