  • How long can i stay?

    Hi,
    Am an F1 student in the USA.. due to financial constraits back home i have decided to take a year off.. so by which time i can stablize a bit back home so i can finish the remaining 1 year in music production? am looking out ofr a job in india and abroad where i get to work and save my question is .. can i stay in the US for an amount of time after i have taken the year break (till i get a job somewhere).. and how long can i stay.. i obviously know that am not allowed to work in here.. (which i dont plan to eighter) what aree the other rules that apply if am allowed to stay for a period of time in the US?

    You can't stay.......
    Generally F-1 students when they arrive in the US are allowed to stay for the time indicated on your papeerwork from the school PLUS SIXTY DAYS.....if you withdraw, its immediate, with the school's permission, its only 15 days.

    Student Visa status has some special issues with regard to overstay. If you chose to stay out of status this is what it means:

    There is a bar to your reentering the US when one overstays. HOWEVER current USCIS interpretation state that a student who goes out of status does not begin to accure time towards a bar UNTIL an immigration offcial (USCIS/judge)makes a ruling that the student is out of status. In practical terms if u stop attending school u will not begin to accure time until someone notices for eg, when u apply for reinstatemnet. Becasue the school is required to report it when u withdraw, they'll notice and since u intend to apply for reinstatemnet, they'll notice.............so in short, you have to leave now if u have already withdrawn.......have u explored another, cheaper school?..........or scholarships?

      thanks For the reply.. i recently spoke with my student councelor ..she said that she can eighter issue me an I-20 with the re-joining dates or (she mentioned a word which i dont quite remeber) i could just leave to inda and request for a newer I-20 when i intend to re-join. which do u think i should do..? she still hasnt gone ahead in processing my papers to withdraw and am still enrolled (registered) for the fall semester (But am on my summer break right now).. please let me the right way to go about this...

        Plan what date you intend to leave and then have them start processing your withdrawal around that time. I'm not sure if she could give you an I-120 now as i think most immigration documents have a life span, but i could be wrong on that..............If she is able to, take the I-120 when youre leaving...and this on etime when you have to document everything and keep copies

        Do you have just an approval or you have the actual F_1 visa stamped in your passport?

        ( BTW Are you aware that you can work full time during the summer with an EAD?..........and that if you can show that your circumstances have changed in such a manner and that the chnage was not foreseeable , you could actually work during the school year for more than 20 hours? ........have you spoken to the school's financial aid dept?)

          I did not know about the EAD thing.. and my student councelor did not tell me about it too when i was talking to her about my sudden financial difficulties in india.. but she did tell me that i can work for 20 hours provided iam enrolled full time in school..

          I have my F-1 visa Stamped under berklee.. which is vaild until 2010 . but i latter transfered to mcnally in Minnesota a year back since it was the same course but shorter and a bit cheaper..My visa is Stamped Under Berklee college of music,Boston . and my I-94 says D/S under "Until" and F-1 under "Status" am not sure what does "M" stand for under Entries in my visa though .

            Actuallly you could work full tim e ON CAMPUS in the school breaks without an EAD but need it for off campus employment.


            D/S means duration of status..........until u finish ur studies
            M...........means mutiple entries.
