I'm currently on OPT status, and actually it had expired on July 6th, but 60 days grace period is given automatically from what I know, I applied for H1B petition and had already given an USCIS receipt notice, and my OPT status will officially ends Sept 6th. That I believe from Sept 6th until the day my H1B petition will be granted, I'll be out of status. I want to go ahead to change my status from F1 to F2.
The questions I have here is, I'm rather confuse - Heard that the change of status now takes 2-3 months? If, I go ahead and file the F2 application, then I get my H1B before the F2, how does that work out? I understand that I-539 cannot be filed if one already has independent nonimmigrant status.
Also, my H1B petition was done through consular processing, now I'm facing some financial problems, so I think I'll have to stay in the U.S, and the legal assistant I'm working with told me that I can do an amended H1B petition, how does that work?
