  • regaring f-1 visa and citizenship "urgent"

Hi my name is Joong and I'm an undergrad attending univeristy of massachusettes. I have f-1 student visa and currently, I'm danger of facing academic suspension, since I didn't do too well this semester after academic probation I was placed on during my freshman year. This means that I would be forced to take a semester off from the university and would be allowed to come back to school the following semester after I take a semester off.
And I was wondering if I stay in the U.S. without Visa about for 3 month for the time where I have to take a semester off how it is going to effect my visa status when I get readmitted the following semester.

Another question I had was, my partner is U.S. citizen and she is willing to
"marry" me in document so I will be able to get citizenship and so I could stay in the U.S. legally during the 3 month where I am forced to take a semester off. I was wondering how this is going to effect my 3 month w/o visa and if i do get married in document how long it would take to get citizenship.

    thanks alot.

    Joong

    Dear fellow

In response to your question, according to terms and conditions stated under your F-1 visa, good performance in school is mandatory to keeping your status, If you have been or in the process of being expelled from your academic institution for poor performance, this becomes an issue both from Immigration service and your Institution or potentiel schools throughout the States. If you are out school for 3 months for such reason, to make matters worse you will need to file for re-instatementwith USCIS .And you will be required to show why you were out of status from the first place.
However what you can do is to show your school that you are willing to show progress through corraborating evidence and the weaken performance you have accumulated is not ordinarly of your nature.
In response to your second question:Marriage to a US citizen could automatically make you eligible to US residency "called Green card" if all conditions are met. This is the law
However ,following your statement I quote"my partner is U.S. citizen and she is willing to "marry" me in document so I will be able to get citizenship and so I could stay in the U.S. legally during the 3 month where I am forced to take a semester off. I was wondering how this is going to effect my 3 month w/o visa and if i do get married in document how long it would take to get citizenship.
This is fraud ,marriage "in document" and could prevent you from ever acquiring immigration benefit.I advise you to reconsider this option, and if you love each other ,marry her otherwise forget it ....find other legal options
I'm a not a lawyer and I'm F-1 as you are.Use my advice with discretion.
Consult an attorney to make informed decision.
    Good luck brother!
