My employer filed I-140 and it is pending right now. My son is on H4 and his h4 expires in Aug07.
He is in a University studying Junior BS and finishes his Junior by Aug07.
If(only guessing) my I-140 get denied( I am little bit being pessimistic here that If i don't get 1year
or 3 year extention and may leave the country with the result)
to plan ahead), What should I do for my son to continue his BS and complete his Senior year by Jun 08
(Othes issue is he becomes 21 years age in May08).
Can he switch to Student Visa F1 and finish his degree? Because his name is included in I-140 as dependent,
will this be a problem to switch to student visa?
