    my wife is with me on my u.s. student visa. she would like her own student visa. we are from india. can this be done? is this difficult? how can this be done and what are the fees associated? thank you.

    she should join a program in some university and apply. and am 100% sure but please check that she should get her F1 visa stamped in the home country and come back.

      divorce/student visa

      thank you topcatin. also, my wife wants a divorce. we are in the u.s. now but separating. how can i facilitate this amicably? separate student visas and the divorce? she wants to stay in u.s. but i want to leave. go back to india.

        First sorry to hear about the separation. But whatever be the case she has to go back and get the F1, there is no short-cut to that. And you need to check on what her status will be after divorce.Because if she is a dependant then her visa status automatically becomes void? I am not sure on this but am 100% sure she has to go back to india to get her F1 in any case.

          deportation?

          sooner or later gonna needs a lawyer i know this. but forum is of much help to gain knowledge of others first. however, if domestic conditions deteriorate and either of us have to answer to the authorities here, then can either of us be deported? thank you topcatin for assistance.

            My understanding is you are on F1 and will finish and go. Your wife is planning on a divorce before you finish...is that correct? if thts the case am certain she goes out of status and will have to return back. You do not want to be caught staying without any legal status. Just go by the law and if either you have to leave, you will have to leave. There is no short cut to this and just go by the book. It will show in their records the next time you plan to come back to the US that you stayed illegally.
