  • F1 International student to H1-B Visa

    I am on F1 international student visa and currently doing internship
    my internship will probably be extended as required by company and the company wants me to work till Dec 2007.

    In the meantime, i got H1-b visa effective Oct 1, 2007.

    However, i want to join my employer in January 2008, and he agreed as this will give me time for completing Masters.
    Also, i want to continue my internship, as it will be partime, once school starts and help to finance my tuition expenses.
    Also do not have to move to different state for H1 employer joining.
    Can anybody let me know, what is my status from Oct 1 till Dec 2007
    If it is H1-b, i cannot do my part time internship which i am eligible on F1

    It is a little surprising that you got your H1 before finishing your studies. Anyway you have it approve for oct2007.thats good.
    Ok so now on Oct1st you automatically change to H1. Internship can be done on F1 and H1 is a work authorization. You need to check on this...I dont think there is a problem in doing the internship. But since you are still in school you should attend classes and make sure that it doesnt interfere with the work schedule.It is confusing because I dont get how you got the H1 before completing your course? But am 100% sure your status changes from F1 to H1 on oct1st. If you have classes to take you need to check with your "international student services" of your university about working and attending classes regularly during your H1.

        not at all.my guess is you have got your H1 through the normal quota and not the master's quota. The masters quota,20000 visas are exclusively reserved for candidates who have a graduate program from the US. And the rest 60000 is for the others to compete.

          Yes the H1-b is thru normal quota.
          But i have opinion from two attorneys and both have contradictory opinion.
          One says that H1-b starts from Oct 1st
          Second says that F1 continues and H1-b starts only after paycheck starts from Employer based on H1-b

          I am not sure whom to believe and what is safe to be legal.

            the oct1st thing is right.
            But when you are on F1, it is not a work authorization.
            So if you go out of status , you shouldnt draw pay-checks while on F1. On F1 you can work 20hours/week only in the university. Internships can be done..unpaid I guess.But I have heard of people working during F1. Your lawyer gives the best info than anyone over here.
